1. Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of the website operated by The
Rocha-Cadman Foundation (“Foundation,” “we,” “us,” or “our”) at
therochacadmanfoundation.com (the “Site”). The Foundation is a California nonprofit public
benefit corporation organized under California Corporations Code § 5110 et seq. (EIN: 39-
2450402).
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy,
which is incorporated herein by reference. If you do not agree to these Terms, you should not
access or use the Site.
2. Use of the Site
The Site is provided for informational purposes and to facilitate charitable donations to the
Foundation. You agree to use the Site only for lawful purposes and in accordance with these
Terms. You represent and warrant that you are at least eighteen (18) years of age or are
accessing the Site under the supervision of a parent or guardian.
You agree not to: (a) use the Site in any way that violates any applicable federal, state, local, or
international law or regulation; (b) impersonate or attempt to impersonate any person or entity,
including any Foundation officer, director, employee, or advisor; (c) interfere with or disrupt the
operation of the Site, including any servers or networks connected to the Site; (d) attempt to
gain unauthorized access to any part of the Site or any systems or networks connected to the
Site; or (e) use any robot, spider, scraper, or other automated means to access the Site without
our prior written consent.
3. Intellectual Property
All content on the Site, including text, images, graphics, logos, design elements, and the
compilation thereof, is the property of the Foundation or its licensors and is protected by
applicable copyright, trademark, and other intellectual property laws. The name “The Rocha-
Cadman Foundation” and the Foundation’s logos are trademarks or service marks of the
Foundation.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly
perform, republish, download, store, or transmit any content on the Site without our prior written

consent, except that you may print or download one copy of a reasonable number of pages for
your own personal, non-commercial use.
4. Donations
Donations made through the Site are processed by third-party payment processors, including
PayPal. The Site also accepts payments through credit and debit cards, Apple Pay, and Google
Pay. By making a donation, you represent that you are authorized to use the payment method
you provide and that the information you supply is accurate and complete.
All donations are final and non-refundable, except where required by applicable law or in cases
of demonstrated error in the transaction amount. If you believe a donation was processed in
error, you must contact us in writing at the address provided in Section 17 within thirty (30) days
of the transaction date. The Foundation will review the claim and, if it determines that an error
occurred, will issue a refund of the erroneous amount.
The Foundation has received recognition of tax-exempt status under Section 501(c)(3) of the
Internal Revenue Code (determination letter dated July 22, 2025). Donations to the Foundation
are tax-deductible to the extent permitted by law. Donors will receive a written acknowledgment
for any single donation of $250 or more, as required by IRS regulations. Please consult your
own tax advisor regarding the deductibility of your specific contribution.
5. User Representations
By using the Site, you represent and warrant that: (a) all information you provide to us is truthful,
accurate, and complete; (b) you will maintain the accuracy of such information; (c) your use of
the Site does not violate any applicable law or regulation; and (d) you have the legal capacity
and authority to agree to these Terms.
6. Disclaimer of Warranties
THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT
WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT
LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE FOUNDATION DOES
NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR
FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE FOUNDATION, ITS
DIRECTORS, OFFICERS, EMPLOYEES, ADVISORS, AND AGENTS SHALL NOT BE LIABLE
FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE,
INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, LOSS OF REVENUE,
OR LOSS OF GOODWILL, EVEN IF THE FOUNDATION HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE FOUNDATION’S AGGREGATE TOTAL LIABILITY TO YOU FOR
ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS EXCEED
ONE HUNDRED DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN
DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS
OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
8. Third-Party Links
The Site may contain links to websites operated by third parties. These links are provided for
your convenience only. The Foundation does not control, endorse, or assume any responsibility
for the content, privacy policies, or practices of any third-party websites. Your access to and use
of any third-party website is at your own risk.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Foundation, its directors, officers,
employees, advisors, and agents from and against any and all claims, liabilities, damages,
losses, costs, and expenses (including reasonable attorneys’ fees and costs) arising out of or
related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any
rights of any third party; or (d) any content or information you submit or transmit through the
Site.
10. Electronic Communications
By using the Site and providing your email address, you consent to receive electronic
communications from us, including donation receipts, acknowledgments, and informational

communications about the Foundation’s mission and activities. You may opt out of non-
transactional communications at any time by following the unsubscribe instructions in any email
or by contacting us at the address in Section 17.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of
California, without regard to its conflict of laws principles. Any dispute arising out of or related to
these Terms or your use of the Site shall be resolved exclusively in the state or federal courts
located in Los Angeles County, California, and you hereby consent to the personal jurisdiction
and venue of such courts.
12. Compliance with Laws
You are responsible for complying with all applicable local, state, national, and international
laws and regulations in connection with your use of the Site.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will
update the effective date at the top of this page and, where practicable, provide notice through
the Site. Your continued use of the Site after any changes are posted constitutes acceptance of
the revised Terms.
14. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal,
or unenforceable, such provision shall be modified to the minimum extent necessary to make it
enforceable, or if modification is not possible, shall be severed. The invalidity of any provision
shall not affect the validity of any other provision.
15. Accessibility
The Foundation is committed to making the Site accessible to individuals with disabilities. We
strive to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. If you

16. General Provisions
Entire Agreement. These Terms, together with the Privacy Policy and any other legal notices
published on the Site, constitute the entire agreement between you and the Foundation with
respect to the Site and supersede all prior communications, whether electronic, oral, or written.
Waiver. No failure or delay by the Foundation in exercising any right, power, or privilege under
these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any
right preclude any other or further exercise thereof.
Assignment. You may not assign or transfer these Terms or any rights hereunder without our
prior written consent. The Foundation may freely assign these Terms without restriction.
Headings. The headings in these Terms are for convenience only and shall not affect their
interpretation.
